Resolution Passed by Asia-Pacific Conference of World Federation of Trade Unions on Anti-Worker Policies of Kazakhstan Regime

 

   Participants in the conference express their concern and protest at the actions of the authorities in Kazakhstan, intended to suppress free trade union activity and to destroy the rights of workers to organize and conduct strikes in their own country.

   The government, at the request of President Nazarbayev have prepared a new draft law “On trade unions” which deprives the workers of the right to create their independent trade unions, initiate labour conflicts and conduct negotiations with employers.

   Despite the fact that the draft law has drawn an official negative reaction from the International Labour Organisation, both the government and the leadership of the state trade union “Federation of Trade Unions of Kazakhstan” are intent on carrying this new law through the parliament.

   This law introduces into the legal system those standards that are already used unofficially in the country. It is the authorities who want to legitimize this policy of terror and state repression against activists and the leaders of worker’ organisations as has already happened in Zhanaozen and Zhezkazgan.

   This is in addition to the continuous refusal to register independent trade unions or to set up clone organisations, as has happened to the Workers’ trade union “Zhanartu”. At the current time, sections of the criminal code already include punishments for “inciting social conflict” and “conducting illegal strikes”. These have already been used against the participants in the months’ long strike of oil workers in West Kazakhstan and also against opposition activists.

   After the shootings by police and military forces of the peaceful demonstration of oil workers in Zhanaozen on 16thDecember 2011, seventeen leaders and participants in the strike were tried, seven of them are still serving their sentences. Amongst them the well-known and popular workers leader Roza Tuletaeva, sentenced to 5 years in prison and Maksat Dosmagambetov serving 6 years.

   Because of their support for strikes in 2012, 8 newspapers and 23 internet publications have been closed as extremist. The same fate has met one opposition party and its leader, the opposition politician Vladimir Kozlov has been sentenced to 7,5 years in prison.

   At the present time, the General Prosecutor of Kazakhstan is introducing a new section to the Criminal code on provoking strikes, which will be a blow against all participants in labour conflicts in the country. The Parliament has already sanctioned the use of live weapons against participants in demonstrations and strikes in the country.

   Participants in the conference demand of the Kazakhstan authorities:

   • An end to all repressions, the release from prison of all arrested oil-workers and political prisoners;

   • The recall of the anti trade union draft law “On trade unions”;

   • The guarantee to workers in Kazakhstan of the rights to organise in their own trade unions and political parties, the right to conduct strikes, demonstrations and protest actions.
